November 2019: 1 winner will receive a gift box of wellness products. The approximate retail value is $1000.
Eligibility
Any supporter who donates or raises $200.00 between November 18, 2019 and December 3, 2019, by midnight, will automatically be entered into a #GivingTuesday19 Giveaway. Anyone 18 years or older and in the United States can enter the giveaway except employees of EndoFound, volunteers of EndoFound, and their respective household or immediate family members, are not eligible to enter. Compliance with the eligibility requirements will be determined solely by EndoFound. All federal, state, and local laws and regulations apply. Void wherever prohibited or restricted by law.
Determination for Awarding of Prize
Following the close of the entry period, 1 winner will be chosen on December 5, 2019, from the full list of entries.
Winner will be notified by email or phone. A prize not timely accepted by a winner will, in EndoFound’s sole discretion, be forfeited for future use by EndoFound, returned to the prize donor, or awarded to an alternate winner. If a prize notification email or any prize is returned to EndoFound or its designated agent as undeliverable, that prize will be awarded to an alternate winner.
EndoFound may, in its sole discretion, choose to substitute a prize of equal or greater value in the event the offered prize is unavailable. Prizes are not redeemable for cash or exchangeable. Transfer of prizes to another individual may be allowed at the discretion of EndoFound and any prize drawing partner or provider.
All potential winners are subject to verification by EndoFound, whose decisions are final and binding in all matters related to the giveaway. Entrants are not a winner of any prize unless and until eligibility and compliance with these Official Rules have been verified and the potential winner has been notified that verification is complete.
Taxes
All taxes on prizes, including but not limited to Federal, State, and Local income and sales taxes, are the responsibility of the winners.
Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s and/or service providers terms and conditions, and winners agree to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. For prizes $600 or more in value, winner’s social security number or taxpayer identification number will be required in order to issue a Form 1099-MISC showing prize Approximate Retail Value (ARV) as income to winner.
Prize consists only of items specifically listed as part of the prize. All costs and expenses not specified herein, related to any prize, including but not limited to delivery, installation, service activation fees and other expenses incurred by accepting the prize, are the sole responsibility of the winner. Prizes will be fulfilled six to eight weeks after the drawing.
Odds of Winning
Odds of winning are determined by the total number of entries received and cannot be projected.
General Terms
EndoFound is not responsible for any typographical or other error in the printing of these Official Rules, administration of the giveaways or in the announcement of prizes, including erroneous appearance of qualification for a prize, and under no circumstances will more than the stated number of prizes be awarded. If for any reason EndoFound is prevented from continuing with this giveaways, or the integrity and/or feasibility of the giveaways is severely undermined by any event including but not limited to breaking news coverage or programming changes, fire, flood, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, EndoFound shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the giveaways without further obligation. If EndoFound in its discretion elects to so abbreviate the giveaways, EndoFound reserves the right, but not the obligation, to award the prize from among all eligible entries received to date. All entries are the property of EndoFound and are not returnable.
This promotion is intended for viewing in the United States only and shall be construed and evaluated only according to United States law. Do not enter this promotion if you are not located in the United States. The use of any automated devices in connection with this promotion is prohibited. EndoFound assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections, whether human, technical or otherwise in nature. EndoFound reserves the right, in its sole discretion, to cancel or suspend this promotion should virus, bugs or other causes beyond its control corrupt the administration, security or proper play of this promotion. EndoFound is not responsible for any injury or damage to any person’s computer or related equipment resulting from or relating to participation in this promotion or downloading any material related to this promotion. Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he or she is the authorized holder of the identified email account or home address.
EndoFound may disqualify entrants if EndoFound believes any entrant has violated these Official Rules or acted in an unsportsmanlike, deceptive, or disruptive manner. Failure by EndoFound to enforce any term of these Official Rules does not constitute a waiver of that provision. If the prize becomes unavailable or infeasible to award, or if any giveaways is impaired or becomes impractical due to any event beyond the control of EndoFound, EndoFound may modify, shorten, suspend, or cancel the giveaways without liability. EndoFound reserves the right to exclude previous giveaways winners from entering this or any future giveaways
Release & Indemnification
Participating in the giveaways is voluntary. Entry constitutes permission for EndoFound (except where prohibited by law) to use entrants’ and winners’ names, hometowns and likenesses in connection with promoting EndoFound without additional compensation. By entering, all entrants agree to be bound by these Official Rules and further agree to release, indemnify and hold harmless EndoFound, its licensees, affiliates, successors, funders, and prize providers, and their respective directors, officers, and employees (“Released Parties”) from and against all actions, causes of actions, and liability, including attorney’s fees and costs, arising out of or relating to participation in the giveaway and receipt and use or misuse of the prize awarded. Entrants acknowledge that the Released Parties have made no warranty, representation or guarantee, expressed or implied, relating to any prize. ALL PRIZES ARE PROVIDED AS-IS.
Choice of Law
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of EndoFound in connection with the contest, shall be governed by the laws of the State of New York without regard to the conflicts of law principles thereof.
